Master Service Agreement & AUP

This Master Service Agreement ("Agreement") governs your acquisition and use of the services provided by RACK MY HOST ("Provider", "we", "us", or "our"). By accepting this Agreement, either by clicking a box indicating your acceptance or by executing an order form that references this Agreement, you agree to the terms of this Agreement.

1. Provision of Services

Provider will make the Services available to Customer pursuant to this Agreement and the applicable Order Forms. We reserve the right to suspend any Service immediately in the event of an emergency, security threat, or violation of our Acceptable Use Policy (AUP).

2. Acceptable Use Policy (AUP) & Zero Tolerance

Customer agrees not to use the Services in a manner that: (a) violates any applicable local, state, national, or international law; (b) infringes upon any third party's intellectual property rights; (c) transmits malicious code, viruses, malware, or phishing attempts; (d) engages in bulk outbound SPAM, DDoS attacks, or network abuse.

Zero Tolerance Enforcement

RACK MY HOST employs a strict Zero Tolerance Policy towards network abuse. Any confirmed violation of the AUP (such as hosting phishing pages, outbound DDoS, or Spamhaus listings) will result in immediate termination of the service without prior warning and without eligibility for a refund. We actively monitor network traffic and cooperate fully with international law enforcement agencies.

3. Billing & Payments

All fees are exclusive of taxes, levies, or duties imposed by taxing authorities. Customer is responsible for payment of all such taxes. Invoices are generated automatically. If an invoice remains unpaid past the due date, the system will initiate automated suspension protocols.

4. Limitation of Liability

IN NO EVENT SHALL RACK MY HOST'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT EXCEED THE TOTAL AMOUNT PAID BY CUSTOMER HEREUNDER FOR THE SERVICES GIVING RISE TO THE LIABILITY IN THE TWELVE MONTHS PRECEDING THE FIRST INCIDENT. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE".
